These Terms of Service govern your use of the Access Shift platform, dashboard, accessibility scanner, and remediation widget. By creating an account or embedding our widget, you agree to these terms.
No legal advice; customer responsibility
Access Shift does not provide legal advice. Nothing in the Service, its documentation, or any communication from Access Shift constitutes or should be relied upon as legal advice. You are solely responsible for evaluating whether the Service meets your legal obligations and for obtaining independent legal counsel.
Compliance disclaimer
This section supersedes any conflicting marketing claim. Access Shift is an accessibility automation tool. Use of the Service does not guarantee, certify, or constitute legal compliance with the Americans with Disabilities Act (ADA), Section 508, the European Accessibility Act (EAA), EN 301 549, the Accessibility for Ontarians with Disabilities Act (AODA), the Accessible Canada Act (ACA), or any other accessibility law, regulation, or standard. Automated tools cannot evaluate or remediate every accessibility success criterion. Access Shift strongly recommends pairing the Service with periodic source-level audits and manual testing by qualified accessibility professionals.
Binding arbitration and class-action waiver
Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration rather than in court. You waive any right to participate in a class action or class-wide arbitration. This arbitration clause does not apply to disputes that qualify for small claims court or to claims for injunctive relief to protect intellectual property.
